The Everway Company Terms and Conditions of Service ("Agreement")

By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this Agreement. If you do not agree to abide by the above, please do not use this service.

1. Customer Information: Collection and storage of information about you in order to complete the services provided by this website are described by our Privacy Policy and you agree to its terms.

2. Informational Purposes Only: This site and its components are offered for informational purposes only; this site shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the site, and shall not be responsible or liable for any error or omissions in that information.

3. Intellectual Property: This site and its original content, features, and functionality are owned by The Everway Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Any contributed content that is excluded from this clause will be clearly attributed to the owner of the contributed content. Any reference in contributed content to intellectual property of The Everway Company remains the property of The Everway Company.

4. Advertising: This site does not include relationships with third-party advertisers.

5. Payment Policy: All payments are due upon order. If a payment is declined, delivery of the ordered goods are not guaranteed. Orders will be filled in a first-come, first-serve manner. Goods will not be shipped until payment has been received in full. Payments are processed through our hosting provider, Squarespace. Acceptable payment instruments are defined by Squarespace and are processed by a third-party credit card processing firm.

6. Refund Policy: Refunds are only accepted if approved by The Everway Company in writing, in advance, and only if the goods do not match the description on the website. Instructions for proper return will be delivered when said approval is granted. In general, only like-new resalable goods may be returned. Refunds are issued only after receipt of the goods in like-new resalable condition. If the item matches the description provided on the website and the buyer is unsatisfied, The Everway Company is not responsible for a refund. Exchanges are granted on a case by case basis.

7. Delivery Policy: When we transfer possession to a delivery service to fulfill your order, we are no longer responsible for missing or delayed packages. Please contact the shipping agent to resolve these circumstances. We encourage the use of shipping insurance to cover damage in transit because The Everway Company will not be held responsible.

8. Contact: Any issues or questions about your order should be directed to contact@everway.com. Please allow up to seven business days for a response. There is no guarantee of a resolution. Each issue will be considered individually.

9. Termination: We may terminate your access to this site, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of this agreement that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Age for Use: You agree that you are at least 16 years of age and have permission of a parent or guardian if legally required in your location in order to use this site.

11: Governing Law: This Agreement is governed in accordance with the laws of Washington state, United States.

12: Changes in Terms and Conditions: The Everway Company reserves the right to change these conditions from time to time as it sees fit, and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers' Personally Identifiable Information, notification by email or postal mail will be made to those affected by the change. Any changes to our privacy policy will be posted on our site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.
